Regulations on Disciplinary Actions for Students of Shishi Tianfu High School
Chapter I General Provisions
Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China, Law on the Protection of Minors of the People's Republic of China, Law on the Prevention of Juvenile Delinquency of the People's Republic of China and other laws and regulations, as well as the Rules for Educational Punishment in Primary and Secondary Schools (Trial Implementation) and other provisions, and in combination with the actual situation of our school, for the purpose of maintaining the normal educational and teaching order of the school, protecting the physical and mental health of students, and promoting the all-round development of students.
Article 2 These Regulations shall apply to all students of our school.
Article 3 The implementation of disciplinary actions against students shall adhere to the combination of education and punishment, and shall be commensurate with the nature of students' illegal and disciplinary acts and the seriousness of their faults. The implementation of disciplinary actions shall be based on sufficient evidence, clear basis, proper procedures, accurate characterization and appropriate punishment.
Chapter II Types and Application of Disciplinary Actions
Article 4 Disciplinary actions against students are divided into the following five types:
(1) Warning;
(2) Serious warning;
(3) Demerit recording;
(4) Probation;
(5) Expulsion from school.
Article 5 Students who have any of the following circumstances may be given a lighter or mitigated punishment:
(1) Voluntarily confessing disciplinary facts and having a good attitude of admitting mistakes;
(2) Voluntarily recovering losses or effectively preventing the occurrence of harmful consequences;
(3) Committing disciplinary acts under coercion or inducement by others;
(4) Cooperating with the school investigation and having meritorious performance;
(5) Other circumstances that may be given a lighter or mitigated punishment.
Article 6 Students who have any of the following circumstances shall be given a heavier or aggravated punishment:
(1) Playing a leading role in joint disciplinary acts;
(2) Disciplinary acts causing serious consequences;
(3) Intentionally concealing or distorting facts and obstructing investigation;
(4) Retaliating against informers or witnesses;
(5) Having been given disciplinary actions for previous violations and violating discipline again;
(6) Other circumstances that shall be given a heavier or aggravated punishment.
Chapter III Disciplinary Acts and Their Punishments
Article 7 Students who violate political discipline and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Organizing or participating in unauthorized assemblies, processions, demonstrations and other activities;
(2) Spreading or disseminating remarks or information that harm national honor, security or social stability;
(3) Producing, disseminating or holding illegal items such as reactionary, obscene, violent or superstitious items;
(4) Other acts that violate political discipline.
Article 8 Students who violate study discipline and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Being absent from class, late or leaving early for a certain number of times;
(2) Disturbing order in class and affecting teaching;
(3) Cheating in exams (see Regulations on Behaviors Violating Exam Management and Their Punishments for details);
(4) Plagiarizing or copying others' homework, papers and other learning achievements;
(5) Other acts that violate study discipline.
Article 9 Students who violate campus order and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Fighting, abusing others or bullying classmates;
(2) Smoking, drinking, gambling or taking drugs;
(3) Intentionally damaging school property;
(4) Stealing, defrauding or robbing others' property;
(5) Chasing, fighting, making noise in the campus, affecting others' normal study and life;
(6) Other acts that violate campus order.
Article 10 Students who violate moral norms and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Slandering, framing others;
(2) Insulting or molesting others;
(3) Participating in pornographic activities;
(4) Other acts that violate moral norms.
Article 11 Students who violate network management regulations and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Spreading false information or maliciously attacking others through the network;
(2) Illegally intruding into others' computer systems or destroying others' network security;
(3) Other acts that violate network management regulations.
Article 12 Students who violate school safety management regulations and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Carrying or hiding controlled knives, inflammable and explosive items and other dangerous items into the campus;
(2) Illegally using electrical appliances or fire sources in the campus;
(3) Leaving school without permission or staying out at night;
(4) Other acts that violate school safety management regulations.
Article 13 Students who violate school accommodation management regulations and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Staying out or accommodating others without permission;
(2) Engaging in activities that affect others' rest in the dormitory;
(3) Damaging dormitory facilities or hygiene;
(4) Other acts that violate school accommodation management regulations.
Article 14 Students who violate school attendance management regulations and have any of the following acts shall be given a warning or above punishment according to the seriousness of the circumstances:
(1) Absent from collective activities organized by the school without reason;
(2) Forging, altering or lending leave notes;
(3) Other acts that violate school attendance management regulations.
Chapter IV Procedures for Disciplinary Actions
Article 15 The implementation of disciplinary actions against students shall be carried out in accordance with the following procedures:
(1) Fact investigation: The school shall investigate the facts of students' disciplinary violations and collect relevant evidence;
(2) Notification: The school shall inform the students of the facts, reasons and basis for the proposed punishment, and listen to the students' statements and defenses;
(3) Decision: The school shall make a punishment decision based on the investigation results and the students' statements and defenses;
(4) Service: The school shall serve the punishment decision on the students themselves and notify their parents;
(5) Filing: The school shall file the punishment decision with the competent education department.
Article 16 For students who are given warning or serious warning punishment, the opinions shall be put forward by the student's class, reviewed by the grade group, and approved by the school's Moral Education Department; for students who are given demerit recording or probation punishment, the opinions shall be put forward by the student's class, reviewed by the grade group, deliberated by the school's Moral Education Department, and approved by the principal's office meeting; for students who are given expulsion from school punishment, the opinions shall be put forward by the student's class, reviewed by the grade group, deliberated by the school's Moral Education Department, approved by the principal's office meeting, and filed with the competent education department.
Chapter V Removal of Disciplinary Actions
Article 17 The period of punishment for students who are given warning, serious warning or demerit recording is 6 months; the period of punishment for students who are given probation is 12 months.
Article 18 During the period of punishment, students who can sincerely repent, behave well and do not violate discipline again may apply for the removal of the punishment.
Article 19 Procedures for the removal of punishment:
(1) The student himself/herself submits a written application;
(2) The student's class and grade group put forward opinions;
(3) The school's Moral Education Department conducts review;
(4) The school approves;
(5) The decision on the removal of punishment shall be served on the student himself/herself and notify his/her parents.
Article 20 After the removal of punishment, students' access to commendations, rewards and other rights shall no longer be affected by the original punishment.
Chapter VI Supplementary Provisions
Article 21 These Regulations shall be interpreted by the school's Moral Education Department.
Article 22 These Regulations shall come into force as of the date of promulgation.
